Legal Structures

How Do You Own Real Estate as a Foreigner?

Bali is a province of Indonesia. Foreigners cannot acquire direct ownership (Hak Milik), but there are three fully legal structures through which a foreign citizen can own real estate in Bali.

Freehold
(Hak Milik)

The most complete form of land ownership in Indonesia.

  • Cannot be held by foreign individuals
  • Not available through a PT PMA either
  • Foreign buyers and investors use one of the rights below instead

Leasehold
(Hak Sewa)

A contractual right to use land or property for an agreed period. You do not buy the land.

  • The term is set in the lease, often 25–30 years
  • Extension is not automatic
  • Extension is agreed with the landowner and usually involves a payment
  • Transfer terms are set in the lease agreement

Right of Build
(Hak Guna Bangunan / HGB)

A right to own buildings on land that is not yours.

  • Can be held by an Indonesian company, including a PT PMA
  • Cannot be held directly by a foreign individual
  • Term and extension depend on the land status and conditions

Right of Use
(Hak Pakai)

A right to use land. For foreign individuals, it can be a route to owning a home, under certain conditions.

  • Residence documents are required
  • Property type and minimum price apply
  • Renting out or running the property needs a separate check
Sources: UU 5/1960 and PP 18/2021. Overview only. Have the structure checked by an Indonesian notary/PPAT and legal adviser.

Proactive Risk Management

How We Manage Risk

Canggu is Bali’s most liquid rental market, with demand all year round. Focused on a boutique, high-end lifestyle-asset niche.

Regular photo updates and progress reports, already 50% complete.

USD-denominated luxury tourism market hedges against local currency fluctuations.

Partnership with Desa Management ensures data-driven, professional operations.

Your Asset, Your Exit Strategy

4 Ways to Realise Value

As Canggu evolves, your property value grows with the underlying land and asset.

Your ownership rights are transferable. A sale depends
on finding a buyer.

Hold for consistent, passive rental income as an inflation hedge.

Our team facilitates a professional, legally sound transfer to a new buyer.
